 Sales

All sales, including but not limited to, price and available quantity of the Product are subject to the final confirmation of Winetian Limited. All orders received verbally, by phone or electronic mail are considered final, no cancellations will be accepted. Unless stated otherwise, all alcoholic products are offered lying in Hong Kong. All goods sold are strictly non-exchangeable and non-refundable.

By placing an order, the Customer confirms that he/she is 18 years old or over. It is illegal to sell alcohol to people under the age of 18 under the Law of Hong Kong SAR.

Wine Conditions

Ullages of all wines offered are top shoulder or better, unless otherwise stated. Although we strive to find wines in their best condition, the Customer must make appropriate allowances for natural variations of ullages, conditions of cases, labels and corks for old wines. We do not accept return of wines for any reason, including corked wines.

Payment

Payment is due within 7 days upon issuance of sales order, except for trade accounts approved by the Company. A zero-balance invoice will be issued to the Customer once full payment is received by Winetian Limited. Method of payment may be in the form of HKD cheque, bank transfer or by credit card or other electronic payment systems accepted by the Company. In the case of payment by credit card or other electronic payment systems, the Customer would be charged an additional 3.2% of the payment amount as transaction fee. For cheque payment or bank transfer, please allow 3 working days for payment to be cleared before goods may be released.

In the event of non-payment of a sales order within the specified terms stated above, Winetian Limited reserves the right to find a replacement customer for the sales order and claim the Customer for any amount between the total sales amount of the original sales order and the replacement sales order that the Company has received less.

In the event that the Company has to consult or appoint external solicitors or other agents to recover the claim, the Customer will indemnify the Company in relation to reasonable fees payable to such solicitors and/or agents.

Delivery/Collection

Winetian Limited provides a free delivery service to one designated address per each fully-paid sales order with a value at or above $2,800.

The current standard delivery fee is $280 per delivery to any one address on the Hong Kong Island, Kowloon and the New Territories.

A person aged 18 or above (identification required) must be present to take delivery, otherwise, delivery shall be withdrawn and attempted at another time to be agreed between the Customer and Winetian Limited. The Customer will be responsible for any extra cost thus incurred.

Deficiencies/Damages

All Customers are requested to examine the goods immediately upon collection or delivery for any deficiencies and/or damages. Claims (if any) must be logged at the time of delivery, otherwise any deficiencies or damages shall be deemed to have occurred thereafter.

Force Majeure

Winetian Limited shall not be liable for any failure to meet our obligations occasioned by circumstances beyond our reasonable control.

Law and Jurisdiction

All sales and contracts are governed by the laws of Hong Kong SAR.
